Minors may no longer be required to submit to breath tests in the city of Kalamazoo
"City officials said enforcement provisions of Kalamazoo’s current ordinance mirror laws in the cities of Troy and Bay City that failed recent court scrutiny.
In the Troy case, Robinson said the Michigan Court of Appeals ruled that a preliminary breath test constitutes a search under the Fourth Amendment, requiring either a search warrant or “unequivocal, specific, and freely and intelligently given” consent from the suspect.
In that case, the court dismissed the charges, ruling that the minors’ consents were not voluntary because Troy officers told them the breath tests were required by ordinance."
