"Getting a new job is hard enough these days, and it's even harder when your prospective employer thinks you're a convicted criminal, even though you're not.
And if you have a name like David Smith, the odds increase that you'll be mistaken for a convict because so many people named David Smith are out there.
Exacerbating the situation is when background check giants like LexisNexis Screening Solutions claim they should be forgiven for bungling a background check because they were following "industry standards." 
And the industry standard, LexisNexis says, means it doesn't always have to run a middle name through the system—even when there are some 125,000 people with the name "David Smith" in the United States.
That was, in part, LexisNexis' defense to a lawsuit brought by a man named David Alan Smith.
Smith claimed LexisNexis was willful and negligent when the company erroneously fingered him as a convict.
He also claims LexisNexis violated the Fair Credit Reporting Act.
Smith was applying to be a delivery driver for Great Lakes Wine and Spirits in 2012.
Image result for that's not meAs a condition of being a driver, his prospective Michigan employer required a background check. LexisNexis conducts some 10 million background checks per year and claims 99.8 percent are never disputed.
To get the background check done, Smith provided Great Lakes with his first, middle, and last name, Social Security number, driver's license number, date of birth, sex, street address, and phone number. Great Lakes did not provide LexisNexis with Smith's middle name, however.
Here's what happened, according to a recent decision (PDF) by the US 6th Circuit Court of Appeals:
Lexis searched its database for criminal records that matched Smith’s first name, last name, and date of birth. 
The search returned two sources—Bay County, Florida Circuit and County Courts, and the Florida Department of Corrections—as having criminal records for a David Smith born on March 12, 1965. This, however, was David Oscar Smith, not the David Alan Smith who applied for the job with Great Lakes. 
The records were for David Oscar Smith's uttering a forged instrument. 
Because Lexis did not receive a middle name from Great Lakes, it could not exclude the middle name "Oscar" from the results. 
The criminal records did not contain a Social Security number, so Lexis could not exclude them on that basis. 
Because the criminal records matched Smith's first name, last name, and date of birth, Lexis included them in the report it provided to Great Lakes.
What's more, the credit report LexisNexis obtained on Smith listed him as "David A. Smith." LexisNexis, however, claimed there "was nothing unreasonable in LexisNexis not cross-checking information in a criminal background report and information in a separate credit report."
After he was denied the delivery job, Smith disputed the criminal background check.
LexisNexis figured out its bungle, and corrected the background report.
Because of the mishap, Smith was delayed six weeks before he could start the delivery job.
Smith sued (PDF) LexisNexis, claiming a breach of the Fair Credit Reporting Act (FCRA) for allegedly failing to follow reasonable procedures that would assure accuracy in the information it reported to Great Lakes..."

"The Arizona Supreme Court issued a stunning and horrifying decision on Tuesday, interpreting a state law to criminalize any contact between an adult and a child’s genitals.
According to the court, the law’s sweep encompasses wholly innocent conduct, such as changing a diaper or bathing a baby. 
As the stinging dissent notes, “parents and other caregivers” in the state are now considered to be “child molesters or sex abusers under Arizona law.” 
Those convicted under the statute may be imprisoned for five years.
How did this happen?
A combination of bad legislating and terrible judging.
Start with the legislature, which passed laws forbidding any person from “intentionally or knowingly … touching … any part of the genitals, anus or female breast” of a child “under fifteen years of age.”
Notice something odd about that?
Although the laws call such contact “child molestation” or “sexual abuse,” the statutes themselves do not require the “touching” to be sexual in nature. 
(No other state’s law excludes this element of improper sexual intent.)
Indeed, read literally, the statutes would seem to prohibit parents from changing their child’s diaper. And the measures forbid both “direct and indirect touching,” meaning parents cannot even bathe their child without becoming sexual abusers under the law.
Arizona’s Supreme Court had an opportunity to remedy this glaring problem.
A man convicted under these laws urged the justices to limit the statutes’ scope by interpreting the “touching” element to require some sexual intent.
But by a 3-2 vote, the court refused and declared that the law criminalized the completely innocent touching of a child..."

I am shocked at the audacity of Hillary Clinton to decry Donald Trump as a birther because her campaign not only pushed that item in a bid to discredit Barack Obama, but mounted a sustained campaign attack Obama on a broad array of issues. How do I know? I was part of that effort and was in regular email and phone coordination with Sidney Blumenthal. Sidney was the conduit who fed damaging material to me that I subsequently posted on my blog.
In some cases Sid Blumenthal actually provided a draft piece that I would slightly modify and publish under my name. Most of the time, however, Sid provided background information and researched material that I would use to craft pieces. How many? I am providing the links to 63 blog articles that I posted (and in one case was posted by Susan Hudgens, who assisted with the blog) between January 2008 and June 30, 2008.
Here is simple summary of material (in writing or through a verbal briefing) that I received from Sid?

The overall level of Earth's surface temperatures is set by solar radiation and also cosmic ray levels, as these can affect cloud formation.

There is a very interesting strong correlation between the climate cycles and the 934-year and superimposed 60-year cycles in the above plot which is derived from planetary orbits.
For those who are interested it is the inverted plot of the scalar sum of the angular momentum of the Sun and all the planets. 
Magnetic fields from the planets may affect solar activity and cosmic rays.
...But to maintain a certain temperature there must be an input of thermal energy (usually called "heat") which balances the natural heat losses.
James Hansen incorrectly assumed that radiation from the colder atmosphere could transfer the extra thermal energy into the surface.
But radiation mostly transfers thermal energy out of the warmer surface, not into it.  
The actual process involves energy being transferred during molecular collisions, as with conduction.  ​
You are familiar with this diffusion process which can be observed if your car is left in the Sun and then driven into your garage. 
Close the garage door and open the car doors and gradually you will feel the temperature of the air in the garage warming and that of the air in the car cooling..."

The federal government happily subsidizes inferior state colleges that graduate few if any of their students. That includes Chicago State University, which has a 12.8 percent six-year graduation rate.

The Obama administration has rewritten federal student loan rules in a way that encourages colleges to raise tuition and effectively subsidizes the worst colleges the most. The Federal Reserve Bank of New York found that each additional dollar in government financial aid results in a tuition hike of about 65 cents.

It does so even though many of their graduates will never pay back their student loans because of their low graduating salaries, and the huge amount of money law students are allowed to borrow from the government. . . . As the Cato Institute’s Neal McCluskey notes, ITT Tech produced better graduating salaries for its students than nearby public alternatives. But no one is suggesting that those lousy public colleges be shut down.
Like most such things, it’s just a transfer of taxpayer resources to Democratic Party constituencies.

Just when it appeared that public interest was fading, celebrity developer Donald Trump has revived the theory that President Barack Obama was born overseas and helped expose the depth to which the notion has taken root—a New York Times poll Thursday found that a plurality of Republicans believe it. If you haven’t been trolling the fever swamps of online conspiracy sites or opening those emails from Uncle Larry, you may well wonder: Where did this idea come from? Who started it? And is there a grain of truth there? The answer lies in Democratic, not Republican politics, and in the bitter, exhausting spring of 2008. At the time, the Democratic presidential primary was slipping away from Hillary Clinton and some of her most passionate supporters grasped for something, anything that would deal a final reversal to Barack Obama.
Tau and Smith detailed in a lengthy four-page-long investigation how in April 2008, when Clinton was slipping in her battle against Obama for the Democratic nomination for the presidency, “Clinton supporters”—as they say—circulated an anonymous email chain that pushed the theory..."

"What is the attraction of socialism?
The Cato Institute held a policy forum Wednesday to consider that question, featuring talks from the moral psychologist Jonathan Haidt and the evolutionary psychologists Leda Cosmides and John Tooby.
One problem they quickly encountered was how to define socialism in the first place.
Is it pervasive, state-directed central planning?
A Scandinavian-style safety net?
Something else?
Sen. Bernie Sanders of Vermont, who pursued the Democratic presidential nomination while describing himself as a socialist, attracted a big following among voters under age 30.
But most of those voters actually rejected the idea of the government running businesses or owning the means of production; they tended to be safety-net redistributionists who want to tax the rich to pay for health care and college education.
And this was, in fact, the platform Sanders was running on.
...Cosmides then turned to a fascinating 2014 study in The Journal of Politics by the Danish political scientists Lene Aarøe and Michael Bang Petersen.
Aarøe and Petersen found that certain cues could turn supposedly individualistic Americans into purportedly welfare-state loving Danes, and vice versa.
In that experiment, researchers asked 2,000 Danes and Americans to react to three cases involving a person on welfare. 

  • In one, they had no background information on the welfare client. 
  • In the second, he lost his job due to an injury and was actively looking for new work. 
  • In the third, he has never looked for a job at all. 

The Danes turned out to be slightly more likely than the Americans to assume that the person they knew nothing about was on welfare because of bad luck.
But both Americans and Danes were no different in opposing welfare for the lazy guy and strongly favoring it for the unlucky worker.
"When we assess people on welfare, we use certain [evolved] psychological mechanisms to spot anyone who might be cheating," Michael Bang Petersen explained in press release about the study.
"We ask ourselves whether they are motivated to give something back to me and society. 
And these mechanisms are more powerful than cultural differences."
Ultimately, Cosmides argued, those of us who want to preserve liberty and prosperity need to understand how human psychology has evolved and understand why evolved attitudes are often counterproductive.
The next panelist, John Tooby, turned to those counterproductive attitudes. Tooby has long been puzzled that so many of his colleagues are not struck by facts like Hong Kong's amazing economic success.
(Its GDP increased 180-fold between 1961 and 1996 while per capita GDP increased 87-fold and inequality fell.)
Instead, even a Nobel-winning economist like Joseph Stiglitz praised Venezuelan strongman Hugo Chavez's ultimately disastrous redistributionist economic policies.
The chief problem, he suggested, is that many people are beguiled by "romantic socialism"—that is, they imagine what their personal lives would be like if everyone shared and treated one another like family..."

This week being no exception, when Democratic presidential nominee Hillary Clinton fainted after an early exit from a 9/11 memorial ceremony in New York City, conservative mainstream media scrambled to theorize on the ever-deepening questions surrounding her health.
Qualifying to head the empire, after all, would ostensibly require a person in their physical prime.
On the other side, left-leaning corporate media — previously exposed for colluding with the Democratic National Committee to bathe the former secretary of state in the glowing light of positivity — was forced to scramble to explain away her sudden inability to stand, while Facebook blatantly censored coverage of the incident in its trending topics section.
After a laughably thin attempt by the Clinton camp to attribute the fainting spell to early autumn heat, we learned she’d been coping with pneumonia — and that her appearance at the memorial actually represented an act of bravery and strength.
Keeping in mind the aforementioned collusion, it’s imperative to also note just six corporations own no less than 90 percent of all media — cable television outlets, radio, and print — in the United States.

This is how brainwashing so exclusively serves the corporate and political plutocrats — vast swaths of the public have no idea what they’re being subjected to.
Repetitive pounding of an idea or phrase gradually shapes thought by reinforcing an idea that might otherwise be doubted. 
When you hear something enough times, it’s easier to accept — as if the number of mentions somehow validates the idea, regardless of merit.
Nowhere has this been more apparent, all political collusion aside, than in coverage of everything pro-Hillary Clinton — and one thing this oligopolistic media couldn’t stand for, all puns intended, is negative publicity from a fainting spell.
But it’s okay — as you’ll see in the telling compilation video below — Hillary might have fainted, but that’s only because she wanted to “power through” her harried schedule despite suffering such a serious illness as pneumonia.
Notably, the intentional choice of the word “power” for its triple-entendre — not only does this push the idea that Clinton isn’t seriously ill, it intimates her desire to work when necessary, no matter the consequences, and subtly reiterates her status as an elite at the height of, well, political power.
